Our Role: AI Deployer

Briefkraft is a Deployer of AI systems within the meaning of the EU AI Act (Regulation (EU) 2024/1689). We are not a manufacturer of AI models and do not develop our own foundation models.

As a Deployer, we use AI services from third-party providers to help our users create social media content. We bear responsibility for the specific use of these systems within our product.

Risk Classification

Minimal risk pursuant to EU AI Act

The AI system used by Briefkraft falls into the category of minimal risk pursuant to the EU AI Act. Briefkraft does not meet any of the criteria for high-risk AI systems:

No social scoring or evaluation of natural persons
No integration into critical infrastructure
No biometric surveillance or identification
No use in the areas of education, employment, law enforcement or justice
No integration into medical diagnosis or safety-critical systems

Purpose and Scope

Content Creation

AI systems are used exclusively to assist with the creation of social media content: text suggestions, captions and post ideas.

Planning & Optimisation

AI-assisted analysis of posting times and content recommendations to support editorial planning.

Human Oversight

Human-in-the-Loop — always

No AI-generated content is published automatically without review by the user. Every post goes through the following process:

AI generates a content draft
Draft is presented to the user in the dashboard for review
User can edit, reject or approve the draft
Content is only published or scheduled after explicit approval by the user

Prohibited Practices

Briefkraft does not use AI systems that are prohibited under Art. 5 of the EU AI Act. In particular:

No subliminal manipulation techniques
No exploitation of vulnerabilities of persons
No social scoring by authorities or companies
No real-time biometric identification in publicly accessible spaces
No creation or expansion of facial recognition databases through untargeted scraping

Transparency towards Users

AI Badge in the Dashboard

All AI-generated content is clearly labelled as such in the dashboard. Users always know which content was suggested by AI.

Disclosure to End Users

Briefkraft recommends that its users label AI-generated content when publishing, pursuant to Art. 50(4) of the EU AI Act, where required by law.

Logging & Traceability

All AI-generated content is logged in our system. Every user can view their complete content history in the dashboard. This enables:

Full traceability of all created content
Revision and correction of content by the user
Audit capability for regulatory requests

AI Systems in Use

Briefkraft uses AI services from external providers. The names of these providers are disclosed in our Terms of Service and Legal Notice (Impressum) in accordance with our transparency obligations under GDPR Art. 13 and the EU AI Act. All AI services used:

are integrated via contractual agreements (terms of service, data processing agreements)
process user data only to the extent necessary (purpose limitation)
are subject, for US-based providers that process personal data, to protection through Standard Contractual Clauses (SCCs); where only anonymised prompts are transmitted (e.g. image/video generation), no personal data transfer occurs

Annual Review

Briefkraft reviews its AI compliance measures at least once a year and updates this page accordingly. The next review is planned for early 2027.
